Seems like a pretty easy win in court, unless it reaches the Supreme Court.
But seriously, so many people let their employers violate the law and don’t do shit about it, even though most lawyers would take the case on contingency.
Like, my job just had a Musk type person come in and fire a bunch of people for not meeting performance goals, despite no performance goals ever being defined and no disciplinary action taken before the firing. And those people weren’t in a department that reported to him. It’s because he was installing sycophants.
And this is for a sector where you can’t actually do that because state law requires a specific process to be followed before terminating anyone. It’s a legitimate problem because most managers won’t follow the process to get rid of actual problem employees.
But not one person has sued, even though it would be a slam dunk case.
