They aren’t arresting her for immigration status, they are arresting her for associating with people, which is in no way a crime. The 5th amendment tends to require indictment by grand jury before any criminal charges.
Maryland does not always require a grand jury indictment
ICE is a federal agency, subject to federal laws.
You are also trying to apply criminal law requirements to immigration which don’t require a grand jury at all.
